BDS Malaysia expresses its deep concern and condemnation over the recent incidents of police intimidation directed at participants of our weekly “Jalan-Jalan Palestine” rallies. This harassment is an unacceptable abuse of power and a direct attack on the fundamental right to peaceful assembly.
Compliance with Laws
Our weekly Jalan-Jalan Palestine rallies are organised in strict adherence to existing laws. The routes are carefully planned to remain on public roads, ensuring no trespassing or stopping at private establishments. Consequently, Subsection 9 (1) (c) of the Malaysian Peaceful Assembly Act 2012 (PAA), which addresses restrictions on public gatherings, does not apply to our events.
Notice to Police
Each week, we dutifully submit a notice to the police 5 days prior to the date of the rally, as required by law, to ensure that our gatherings are lawful and transparent. It is crucial to emphasise that there is no longer a requirement for a police permit for such gatherings; the organiser is merely required to inform the police of the proposed event.
Misinformation and Harassment
Despite our compliance, the police have been summoning attendees to the station for investigation, falsely claiming that our rallies lack permits and that the organiser is breaking the law. This misinformation is creating unnecessary anxiety among participants and is a clear example of the authorities’ blatant abuse of power.
Rights of Participants
Members of the public who attend our weekly gatherings are exercising their constitutional right to freedom of assembly, as guaranteed under Article 10 (1)(b) of the Federal Constitution of Malaysia. They are not in violation of any laws. This fundamental right must be respected and upheld by all authorities.
Call for Reform
We call on Home Minister Saifuddin Nasution to urgently revisit your reform agenda. The Peaceful Assembly Act 2012 must be amended as a priority. This outdated law has led to numerous incidents of harassment, intimidation, and censorship of Malaysian voices. It is high time for the government to uphold and protect the right to peaceful assembly rather than stifle it through archaic regulations and abusive practices.
